3. Account Registration

To use our Services, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You must notify us immediately of any unauthorized use of your account or any other security breach.

We recommend configuring your AI assistant to provide appropriate recording disclosures at the beginning of calls.

The Services, including all software, content, trademarks, and technology, are owned by or licensed to Thermoi and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Your Content

You retain ownership of content you provide to us (business information, scripts, etc.). By providing content, you grant us a non-exclusive, worldwide license to use, process, and store such content to provide the Services.

Our Services may integrate with third-party applications and services. Your use of such third-party services is subject to their terms of service and privacy policies. We are not responsible for the performance, availability, or practices of third-party services.

9. Service Availability and Modifications

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERMOI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Thermoi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Services if you breach these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Services ceases immediately.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
